Responsibility For The Payment of Marital Liabilities
Upon a divorce the judge will assign the responsibility for the payment of an existing liability to the spouse who received the asset that was acquired through the creation of that liability.
Where there is no asset, then the spouse who benefited from the creation of that liability is responsible.
