Ante-nuptial or Prenuptial Agreement

This is an agreement between the parties of a marriage to alter the rights otherwise given to a married couple by law.

There are three typical outcomes:

1. Happily Ever After (never divorce)
2. Both agree to the prenup and carry it out
3. One party disagrees and the court must determine if the contract is valid.

When is a prenup valid?

A Prenup is valid when it meets the following criteria:

1. It is the product of complete financial disclosure between the parties. It must be honest and complete.
2. The terms were fair at the time the agreement was created.
3. The terms are still fair at the time of the divorce. (Hardest test to pass)
